Status Definitions for Lawyers

In Private Practice
A lawyer who is practising law and/or providing legal services to clients. This includes sole practitioners; partners, associates and employees in law firms.

Practising Law - Employed
A lawyer who is employed practising law and/or providing legal services exclusively for the lawyer's employer.

Not Practising Law - Employed
A lawyer who is employed by an organization such as government, an educational institution, a company, a society, trade union, etc., and who does not provide legal services.

Not Practising Law
A lawyer who is not currently practising law and/or providing legal services.

Practice Restricted
A lawyer who is practising law but who is restricted in the manner or in the areas of law in which they may practise, or in the legal services they may provide. For example, the lawyer may only be permitted to practise as an employee or under the supervision of another lawyer, or may not be permitted to practise with respect to real estate matters.

Suspended Administratively
A lawyer who has been suspended for administrative reasons, such as failing to pay fees or file forms on time. A suspended lawyer is not permitted to practise law and/or provide legal services.

Suspended
A lawyer who has been suspended by order of the Law Society Tribunal or for failing to pay a costs order of the Law Society Tribunal by the deadline for payment. A suspended lawyer is not permitted to practise law and/or provide legal services.

Undertaking Not to Practise
A promise or pledge not to practise law or provide legal services made by a lawyer or paralegal to the Law Society, usually in writing, during the course of regulatory activity, which may be permanent, or temporary until the regulatory activity is concluded.

Licence Surrendered - By Order of the Law Society Tribunal 
A former lawyer who was authorized by the Law Society to surrender their licence by order of the Law Society Tribunal. A person who has surrendered their licence is not licensed by the Law Society to practise law and/or provide legal services.

Licence Surrendered - Administrative Surrender of Licence
A former lawyer who applied to surrender their licence and whose application was accepted. A person who has surrendered their licence is not licensed by the Law Society to practise law and/or provide legal services.

Licence Surrendered – Retired
A former lawyer who applied to surrender their licence after they retired from practising law and whose application was accepted. A person who has surrendered their licence is not licensed by the Law Society to practise law and/or provide legal services.

Licence Surrendered - In the Face of Regulatory Proceedings**
A former lawyer who applied to surrender their licence in the face of a Law Society audit, investigation or search and seizure or a proceeding before the Law Society Tribunal and whose application was approved. A person who has surrendered their licence is not licensed by the Law Society to practise law and/or provide legal services.

Licence Revoked
A former lawyer whose licence was revoked by order of the Law Society Tribunal. A person whose licence has been revoked is not licensed by the Law Society to practise law and/or provide legal services.

Licence Revoked - Administrative Suspension Over 12 Months
A former lawyer whose licence was revoked under subsection 48(1)(a) of the Law Society Act, following an administrative suspension that was still in effect more than 12 months after it was made. A person whose licence has been revoked is not licensed by the Law Society to practise law and/or provide legal services.

Licence Revoked - Regulatory Suspension Over 24 Months
A former lawyer whose licence was revoked under subsection 48(1)(b) of the Law Society Act, following a regulatory suspension that was still in effect more than 24 months after it was made. A person whose licence has been revoked is not licensed by the Law Society to practise law and/or provide legal services.

Licensee Participating in PBLO (PBLO Emeritus Lawyer)
A lawyer who only practises law through a program registered with Pro Bono Ontario.

Practising Law - Canadian Legal Advisor
A lawyer with a Class L3 licence who is employed practising law and/or providing legal services in Ontario. This includes sole practitioners; partners, associates and employees in law firms.

Status Definitions for Paralegals

In Private Practice
A paralegal who is licensed to provide legal services in the areas permitted within the scope of practice. This includes sole practitioners; partners, associates and employees in paralegal firms.

Providing Legal Services - Employed
A paralegal who is employed and providing legal services exclusively for the paralegal's employer.

Not Eligible to Provide Legal Services - No Proof of Insurance
A paralegal who is not eligible to provide legal services - no proof of insurance.

Not Providing Legal Services - Employed
A paralegal who is employed by an organization such as government, an educational institution, a company, a society, trade union, etc., and who does not provide legal services.

Not Providing Legal Services
A paralegal who is not currently providing legal services.

Practice Restricted
A paralegal who is providing legal services but who is restricted in the manner or in the areas in which they may provide legal services, or in the legal services they may provide. For example, the paralegal may only be permitted to provide legal services as an employee or under the supervision of another paralegal or may not be permitted to provide legal services with respect to Highway Traffic Act matters.

Suspended Administratively

Lawyer Licence Type Definitions

Class L1

Subject to any terms, conditions, limitations or restrictions imposed on the class of licence or on the licensee and subject to any order made under The Law Society Act, a licensee who holds a Class L1 licence is entitled to practise law in Ontario as a barrister and solicitor.

Class L2

Subject to any terms, conditions, limitations or restrictions imposed on the class of licence or on the licensee and subject to any order made under The Law Society Act, a licensee who holds a Class L2 licence is entitled to practise law in Ontario as a barrister and solicitor in the employ of the Attorney General for Ontario or, if appointed under the Crown Attorneys Act, as a Crown Attorney or as an assistant Crown Attorney.

Class L3

Subject to any terms, conditions, limitations or restrictions imposed on the class of licence or on the licensee and subject to any order made under The Law Society Act, a licensee who holds a Class L3 licence is authorized to do any of the following:

  1. Give a person advice with respect to,
    1. the laws of Quebec,
    2. the laws of Canada, and
    3. public international law.
  2. Select, draft, complete or revise a document for use in a proceeding with respect to matters concerning the laws of Canada.
  3. Represent a person in a proceeding before an adjudicative body with respect to matters concerning the laws of Canada.

Paralegal Licence Type Definitions

Class P1

Subject to any terms, conditions, limitations or restrictions imposed on the class of licence or on the licensee and subject to any order made under The Law Society Act, a licensee who holds a Class P1 licence is authorized to do any of the following:

  1. Give a party advice on his, her or its legal interests, rights or responsibilities with respect to a proceeding or the subject matter of a proceeding.
  2. Represent a party before,
    1. in the case of a proceeding in the Small Claims Court, before the Small Claims Court,7
    2. in the case of a proceeding under the Provincial Offences Act, before the Ontario Court of Justice,
    3. in the case of a proceeding under the Criminal Code, before a summary conviction court,
    4. in the case of a proceeding before a tribunal established under an Act of the Legislature of Ontario or under an Act of Parliament, before the tribunal, and
    5. in the case of a proceeding before a person dealing with a claim or a matter related to a claim, before the person.
  3. Anything mentioned in subsection 1 (7) of The Law Society Act, provided the activity is required by the rules of procedure governing a proceeding.
  4. Select, draft, complete or revise, or assist in the selection, drafting, completion or revision of, a document for use in a proceeding.
  5. Negotiate a party's legal interests, rights or responsibilities with respect to a proceeding or the subject matter of a proceeding.
  6. Select, draft, complete or revise, or assist in the selection, drafting, completion or revision of, a document that affects a party's legal interests, rights or responsibilities with respect to a proceeding or the subject matter of a proceeding.
